{"id":1091,"date":"2023-10-16T22:14:49","date_gmt":"2023-10-17T02:14:49","guid":{"rendered":"http:\/\/responsiblewakes.org\/?p=1091"},"modified":"2023-10-16T22:14:49","modified_gmt":"2023-10-17T02:14:49","slug":"is-no-news-from-the-anr-good-news","status":"publish","type":"post","link":"http:\/\/responsiblewakes.org\/?p=1091","title":{"rendered":"Is No News from the ANR Good News?"},"content":{"rendered":"\n<p>This is a question we\u2019ve been asking ourselves for the last several weeks as we await the ANR\u2019s final decision on changes to the&nbsp;<a href=\"https:\/\/dec.vermont.gov\/sites\/dec\/files\/documents\/Use_of_Public_Waters_Rules.pdf\">Use of Public Water Rules<\/a>&nbsp;regarding&nbsp;wake boats. This is&nbsp;<em>also<\/em>&nbsp;a question many of you \u2014 our supporters \u2014 have been asking us for nearly a month. We don\u2019t have insight into where ANR is in their rulemaking process; we don\u2019t know what to tell you other than, like you, we await the ANR\u2019s final rule.&nbsp;<\/p>\n\n\n\n<p>We&nbsp;anticipate this news may come soon. This is based on&nbsp;the public comment period \u2014 which included two public hearings and written comments \u2014 having ended August 10. After review of the public input, DEC made its final confidential recommendations to the ANR. Several weeks have passed since ANR Secretary Julie Moore received those recommendations.<\/p>\n\n\n\n<p>What does such a long information drought indicate? Is it good news or bad?<\/p>\n\n\n\n<p>In our October 5 Newsletter, we included&nbsp;<a href=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2023\/10\/RWVL-Letter-to-Secretary-Moore-9.25.23.pdf\">our group\u2019s September 25 letter to Secretary Moore<\/a>. In what was a compelling letter we:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Summarized our group\u2019s efforts during the last 2&nbsp;\u00bd&nbsp;years,&nbsp;<\/li>\n\n\n\n<li>Explained our rationale for a stronger, more appropriate rule than the DEC\u2019s draft 500-foot distance from shore, and&nbsp;<\/li>\n\n\n\n<li>Described support we have received from various quarters for a stronger rule that includes our group\u2019s recommended minimum 1,000-foot distance from shore for wake boat activity. In addition to referencing the wealth of accumulated scientific data (some of which only became available\u00a0<em>after<\/em>\u00a0we filed our March 2022 petition to the ANR), RWVL pointed out that over 80% of the 759 written comments received by the ANR supported a strong wake boat rule, i.e., a minimum 1,000-ft distance from shore (41%) or a statewide total ban (41%) on all such boat activity on inland lakes.<\/li>\n<\/ul>\n\n\n\n<p>We are hopeful that the above points will persuade Secretary Moore to strengthen the rule beyond the ANR\/DEC\u2019s original draft 500-foot recommended distance.
