{"id":1304,"date":"2024-02-14T08:44:39","date_gmt":"2024-02-14T13:44:39","guid":{"rendered":"http:\/\/responsiblewakes.org\/?p=1304"},"modified":"2024-02-14T08:44:39","modified_gmt":"2024-02-14T13:44:39","slug":"tomorrow-is-d-day-lcar-likely-to-vote-on-anrs-rule-to-manage-wake-boats","status":"publish","type":"post","link":"http:\/\/responsiblewakes.org\/?p=1304","title":{"rendered":"Tomorrow Is D-Day\u2014LCAR Likely to Vote on ANR\u2019s Rule to Manage Wake Boats"},"content":{"rendered":"\n<p>Tomorrow morning,&nbsp;<a href=\"https:\/\/legislature.vermont.gov\/committee\/agenda\/2024\/6252\">Thursday, February 15, the Legislative Committee on Administrative Rules (LCAR) meets<\/a>&nbsp;for a third, possibly final, time to determine the fate of \u201c<em>23-P17 &#8211; Agency of Natural Resources\/Vermont Use of Public Waters Rules.<\/em>\u201d Beginning 8:25&nbsp;AM,&nbsp;LCAR will discuss and then vote on whether the ANR followed the required statutory petition process&nbsp;for&nbsp;the&nbsp;<a href=\"https:\/\/dec.vermont.gov\/sites\/dec\/files\/wsm\/lakes\/docs\/apafilingforms_wakeboats%20Final%20Rule%20Filing%202.1.24%20LCAR.pdf\">Wake Boat Rule they announced January 3<\/a>. It was only after considerable discussion and heart wrenching debate that we decided getting a rule in place for this upcoming summer\u2019s boating season was more important than getting the perfect rule. This decision was supported by most \u2014 but not all \u2014 of our supporters because of our belief that the benefits of not delaying implementation of a rule for this summer is supported by the three compelling reasons illustrated here:\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"301\" src=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/02\/RWVL-Reasons-to-support-ARN-Rule-for-this-summer-1024x301.png\" alt=\"\" class=\"wp-image-1308\" srcset=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/02\/RWVL-Reasons-to-support-ARN-Rule-for-this-summer-1024x301.png 1024w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/02\/RWVL-Reasons-to-support-ARN-Rule-for-this-summer-300x88.png 300w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/02\/RWVL-Reasons-to-support-ARN-Rule-for-this-summer-768x226.png 768w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/02\/RWVL-Reasons-to-support-ARN-Rule-for-this-summer.png 1077w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>For tomorrow\u2019s meeting, RWVL has requested that LCAR insist on two important modifications that will strengthen the ANR\u2019s Final Rule:\u00a0<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>When user conflicts arise, they are resolved by giving deference to \u201cnormal uses\u201d as defined in Section 5.6 of the Use of Public Waters Rules (UPWR); and\u00a0\u00a0<\/li>\n\n\n\n<li>TBroadening the ANR\u2019s UPWR definition of \u201c<em>wake boat<\/em>\u201d to include additional boat technologies and designs that enhance wake size.\u00a0<\/li>\n<\/ol>\n\n\n\n<p>Even if LCAR votes tomorrow to support the adoption of the ANR Rule, RWVL\u2019s work will not be done.
