{"id":1448,"date":"2025-07-21T12:02:20","date_gmt":"2025-07-21T16:02:20","guid":{"rendered":"http:\/\/responsiblewakes.org\/?p=1448"},"modified":"2025-07-21T17:52:20","modified_gmt":"2025-07-21T21:52:20","slug":"dec-denies-all-nine-lake-petitions-to-prohibit-wakesports-proposes-changes-to-statewide-rules","status":"publish","type":"post","link":"http:\/\/responsiblewakes.org\/?p=1448","title":{"rendered":"DEC Denies All Nine Lake Petitions to Prohibit Wakesports \u2013 Proposes Changes to Statewide Rules\u00a0"},"content":{"rendered":"\n<p>On Friday, June 13, nine Vermont lake associations (representing 10 lakes) learned that their petitions to prohibit wakesports and\/or wake boats on their lakes were denied by the Department of Environmental Conservation (DEC).&nbsp;&nbsp;In its decision, the DEC explained that rather than address issues on a lake-by-lake basis, it makes more sense to reopen the Agency of Natural Resources\u2019 (ANR) Use of Public Waters (UPW) rulemaking process to refine and expand on the rules it adopted in April 2024. RWVL strongly supports this reduction as it protects 12 more lakes. However,&nbsp;<strong>we strongly oppose the removal of the Home Lake Rule.&nbsp;<\/strong>The addition of the Home Lake Rule was the reason our group agreed to the ANR\u2019s proposed rule changes last year.<strong>&nbsp;<\/strong>This rule<strong>&nbsp;<\/strong>establishes effective, state-approved wake boat decontamination stations in which boats are required to be decontaminated when traveling from one lake to another, and we view it as essential in preventing the spread of lake-to-lake aquatic invasive species (AIS).&nbsp;&nbsp;<\/p>\n\n\n\n<p>The DEC\u2019s proposed timeline for the entire rulemaking petition process, detailed below, will run 6 to 8 months.&nbsp;&nbsp;Solicitation of public input kicks off with pre-rulemaking meetings on July 30 and 31.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"525\" src=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/DEC-Timeline-Next-Steps-July-2025-1024x525.png\" alt=\"\" class=\"wp-image-1454\" srcset=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/DEC-Timeline-Next-Steps-July-2025-1024x525.png 1024w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/DEC-Timeline-Next-Steps-July-2025-300x154.png 300w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/DEC-Timeline-Next-Steps-July-2025-768x394.png 768w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/DEC-Timeline-Next-Steps-July-2025.png 1146w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><strong>RWVL WILL CONTINUE TO ADVOCATE FOR THE FOLLOWING DURING PRE-RULEMAKING:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>One lake -per-season limit on wake boats until effective ballast inspection (as required by law) and decontamination exists.<\/li>\n\n\n\n<li>Application of&nbsp;the \u201c<a href=\"https:\/\/unesdoc.unesco.org\/ark:\/48223\/pf0000139578\">Precautionary Principle<\/a>\u201d&nbsp;in present and all future VT UPW rulemaking.&nbsp;<\/li>\n\n\n\n<li>Inclusion of a specific statement that wakesports are not a \u201cnormal use\u201d as defined in the UPW and a clear statement of the implications of this designation for present and future DEC rulemaking in Vermont. Make it clear in the UPWR wakesports definition that wakesports are not a normal use.<\/li>\n\n\n\n<li>A 30-foot minimum depth for wakesports operation, established by recent research as the minimum depth to prevent lake bottom disturbance, rather than the 20-foot depth proposed by the DEC.&nbsp;<\/li>\n\n\n\n<li>A 1,000-foot minimum distance from shore for wakesports operation, requested in our&nbsp;<a href=\"https:\/\/dec.vermont.gov\/sites\/dec\/files\/wsm\/lakes\/docs\/RWVL_ANR%20Petition%20to%20Manage%20Wake%20Boats_Revised_6132022.pdf\">RWVL March 2022 petition to the ANR<\/a>&nbsp;based on the scientific literature included on pages 13 to 17, rather than the 500-foot distance proposed by the DEC.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>HOW YOU CAN HELP<\/strong>&nbsp;(<strong>we&nbsp;<u>cannot<\/u>&nbsp;overstate the importance of your continued support)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Demonstrate your support (even if you do not plan to speak), by attending, either in person or&nbsp;<a href=\"https:\/\/teams.microsoft.com\/dl\/launcher\/launcher.html?url=%2F_%23%2Fl%2Fmeetup-join%2F19%3Ameeting_YWRjYWU1OTUtMmFiNC00NzBjLTgzZTQtMDRkMzRmZGE4Nzlh%40thread.v2%2F0%3Fcontext%3D%257b%2522Tid%2522%253a%252220b4933b-baad-433c-9c02-70edcc7559c6%2522%252c%2522Oid%2522%253a%2522da78b215-83db-495d-89a6-ce6387c3d4df%2522%257d%26anon%3Dtrue&amp;type=meetup-join&amp;deeplinkId=205b534a-7e85-4594-9d50-bdc82effc96b&amp;directDl=true&amp;msLaunch=true&amp;enableMobilePage=true&amp;suppressPrompt=true\">by remote Teams link<\/a>,&nbsp;one or both of these two DEC\u2019s pre-rulemaking public meetings:&nbsp;&nbsp;<ul><li>July 30, 2025, at 6pm in the VTrans Dill Building, 2178 Airport Road, Barre, VT 05641.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>July 31, 2025, at 6pm in the Gateway Center, 84 Fyfe Drive, Newport, VT 05855.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Note:&nbsp;&nbsp;These are NOT public hearings at which public testimony will be heard.&nbsp;&nbsp;The DEC intends these to be informal meetings at which the public will be given an opportunity to comment on various provisions of the proposed new rules.&nbsp;&nbsp;RWVL will have our subject matter experts weighing in on the proposed changes.
