{"id":1457,"date":"2025-07-29T13:07:29","date_gmt":"2025-07-29T17:07:29","guid":{"rendered":"http:\/\/responsiblewakes.org\/?p=1457"},"modified":"2025-07-29T13:07:29","modified_gmt":"2025-07-29T17:07:29","slug":"what-you-need-to-know-about-the-july-30-and-31-dec-wakesports-meetings","status":"publish","type":"post","link":"http:\/\/responsiblewakes.org\/?p=1457","title":{"rendered":"What You Need to Know About the July 30 and 31 DEC Wakesports Meetings"},"content":{"rendered":"\n<p>In the words of Yogi Berra, \u201cIt\u2019s&nbsp;<em>deja vu&nbsp;<\/em>all over again.\u201d&nbsp;Barely a year after implementing its first-in-the-nation statewide rule for managing wakesports, the Department of Environmental Conservation (DEC) announced its intention to update the 2024&nbsp;<a href=\"https:\/\/dec.vermont.gov\/sites\/dec\/files\/documents\/Use_of_Public_Waters_Rules.pdf\">Vermont Use of Public Waters<\/a>&nbsp;(UPW) Rules. Two&nbsp;pre-rulemaking&nbsp;meetings are scheduled for&nbsp;July 30 and 31&nbsp;to solicit public comments.&nbsp;<\/p>\n\n\n\n<p>Why is this happening? Per the DEC:<\/p>\n\n\n\n<p><em>\u201c<\/em><em>The proposed [2025 wakesports] updates are to better address safety concerns, reduce public use conflicts, and to implement clarifications in the rule to increase compliance for the regulated community. Additional updates to the set of rules are recommended to address technical corrections.\u201d<\/em><\/p>\n\n\n\n<p>In other words, the DEC acknowledges it made mistakes in formulating last year\u2019s rule\u2014 two years in the making \u2014 and it now proposes to fix and strengthened it.&nbsp;&nbsp;The chart below compares the proposed changes to the rule adopted in 2024.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1008\" height=\"999\" src=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/RWVLs-simplified-summary-of-the-proposed-DEC-changes-7.2025.png\" alt=\"\" class=\"wp-image-1452\" srcset=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/RWVLs-simplified-summary-of-the-proposed-DEC-changes-7.2025.png 1008w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/RWVLs-simplified-summary-of-the-proposed-DEC-changes-7.2025-300x297.png 300w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/RWVLs-simplified-summary-of-the-proposed-DEC-changes-7.2025-150x150.png 150w, http:\/\/responsiblewakes.org\/wp-content\/uploads\/2025\/07\/RWVLs-simplified-summary-of-the-proposed-DEC-changes-7.2025-768x761.png 768w\" sizes=\"auto, (max-width: 1008px) 100vw, 1008px\" \/><\/figure>\n\n\n\n<p>RWVL strongly supports many of the DEC\u2019s proposed changes, which will prohibit wakesports on an additional 12 of Vermont\u2019s 30 inland lakes and ponds eligible for wakesports under the 2024 rule.&nbsp;&nbsp;However, our group maintains that the DEC\u2019s proposal is still&nbsp;<em>not<\/em>&nbsp;strong enough. Additional improvements are needed:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Inclusion of the \u201c<\/strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Precautionary_principle\"><strong>Precautionary Principle<\/strong><\/a><strong>\u201d in the UPW Rules<\/strong>\u00a0as it applies to wakesports and as a guide for future rulemaking.<\/li>\n\n\n\n<li><strong>A clarifying UPW Rules statement that Wakesports are a \u201cNon-Normal\u201d Use.\u00a0<\/strong>This designation specified by DEC Commissioner Batchelder at the Feb 15, 2024, LCAR meeting (see\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=86Tjkz-2lGY&amp;t=2510s\">video: 10:35\u201311:15<\/a>) needs to be included, defined, and its significance explained.<\/li>\n\n\n\n<li><strong>A 30-foot minimum wakesports operational depth requirement<\/strong>, which is<strong>&nbsp;<\/strong>supported by new scientific data and adheres to the Precautionary Principle.<\/li>\n\n\n\n<li><strong>A 700-foot minimum wakesports operational distance from shore and from other lake users.&nbsp;<\/strong>This is based on the&nbsp;<a href=\"https:\/\/conservancy.umn.edu\/items\/bd2d2968-21c4-4726-8a61-53e7daafcb56\">2022 scientific study from the University of Minnesota<\/a>&nbsp;and by the&nbsp;<a href=\"http:\/\/responsiblewakes.org\/wp-content\/uploads\/2024\/12\/Approval-Memo-Wakeboat-Rule-Modifications-from-Comments-for-LCAR13-1.pdf\">DEC staff\u2019s Sept. 18, 2023 recommendation<\/a>&nbsp;to ANR Sec. Julie Moore. Ask them to attend remotely or in person to learn about the DEC\u2019s 2025 proposed statewide changes to their 2024 UPW Wakesport Rule. Mention that this is a non-partisan issue. Be sure to indicate in the subject line that you are a constituent of theirs.<\/li>\n\n\n\n<li><strong>Share this email with interested friends, neighbors, and relatives<\/strong>, and ask them to attend and speak in support of RWVL\u2019s stronger rule at one or both of these meetings.&nbsp;&nbsp;<\/li>\n\n\n\n<li>Provide&nbsp;<strong>written comments AFTER the two public meetings<sub>&nbsp;<\/sub>but before the Tuesday, August 19 4:30 PM deadline. <\/strong>(Note: this deadline has been extended from the original August 11 deadline.) FYI: if you are unable to participate in either of these two meetings, the YouTube video links should be available within a few days on the DEC\u2019s&nbsp;<a href=\"https:\/\/dec.vermont.gov\/watershed\/lakes-ponds\/lakes-and-ponds-rulemaking\">Lakes and Ponds Rulemaking Page<\/a>.<\/li>\n<\/ol>\n\n\n\n<p><strong>What should I know about the format for the two DEC public meetings<\/strong>?<\/p>\n\n\n\n<p>The DEC describes these two meetings as \u201cinteractive\u201d and \u201cdiscussion-based,\u201d&nbsp;so there is no need to sign up beforehand to speak. To prepare, RWVL recommends careful review of the following:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The IMPORTANT&nbsp;<strong>DEC \u201cFAQ document\u201d<\/strong>&nbsp;which is accessed&nbsp;<a href=\"https:\/\/dec.vermont.gov\/sites\/dec\/files\/documents\/FAQ%20on%20proposed%20changes%20to%20the%20UPWR.pdf\"><strong>HERE<\/strong><\/a>.&nbsp;<\/li>\n\n\n\n<li>The July 22&nbsp;<strong>comments of DEC staff member, Laura&nbsp;Dlugolecki<\/strong>, regarding procedures at the meetings:<\/li>\n<\/ol>\n\n\n\n<p>\u201c[W]e plan to show the Agency&#8217;s proposed language on a slide for a specific topic and to then take feedback on those proposed changes. Folks can raise their hands to provide feedback. We aren&#8217;t giving people a time cutoff &#8230;<\/p>\n\n\n\n<p>\u201cThese meetings are meant to be interactive so that the public can provide feedback and suggestions.
